In order to resolve the desire to convert business households into enterprises which are actually existing but not regulated by law, Decree No. 108\/2018\/ND-CP which will take effect from 10\/10\/2018 has added provisions on procedures for conversion from business households to enterprises<\/p>\n

Accordingly, business households wishing to convert to register enterprise should implement the conversion registration as follows:<\/p>\n

1.\u00a0\u00a0\u00a0\u00a0 The authority in charge of receiving and handling: The Business Registration Office of the province where the enterprise\u2019s headquarters is situated.<\/p>\n

2.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The applications include:<\/p>\n

–\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The original of Certificate of business household registration;<\/p>\n

–\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The notarized copy of tax registration certificate;<\/p>\n

–\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The application of enterprise registration;<\/p>\n

–\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 One of the notarized copy of personal identification papers of the owner (for the private enterprises, single-member limited liability company); of the shareholders in Join Stock Company, general partners of partnerships and members of multi-member limited liability companies;<\/p>\n

–\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The decision on establishment or certificate of enterprise registration or an equivalent document, ID paper of the authorized representative and the power of attorney if the founder is an organization;<\/p>\n

–\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The certificate of investment registration if the enterprise is founded or co-founded by foreign investors or foreign-invested business organizations according to the Law on Investment and its guiding documents for implementation;<\/p>\n

–\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The Charter of Company (for the Joint stock company, limited liability company, partnership);<\/p>\n

–\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 List of members of the multi-member limited liability company or partnership; list of founding shareholders and foreign shareholders of the joint-stock company. List of authorized representatives of foreign shareholders being organizations.<\/p>\n

3.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The settlement procedure: within 02 working days from the issuance date of Enterprise Registration Certificate, Business Registration Office sends the notarized copy of Enterprise Registration Certificate and the original of business household registration Certificate to Business Registration Authority of the district level where the business household\u2019s headquarters is situated to implement the termination of business household operation.\/.<\/p>\n","protected":false},"excerpt":{"rendered":"
